By-laws

 

Article One

(Name)

Section 1.

The name of this association shall be the “Private Investigators Association of Idaho”.

Article Two

(Objective)

The purpose of this association will be:

Section 1.

To ensure better understanding and promote professional and social practices in the private investigating industry in the state of Idaho.

Section 2.

To provide information to facilitate an interchange of ideas and information on subjects of common interest to its members.

Section 3.

To further establish a mutual feeling of trust, goodwill, friendship and a spirit of cooperation among private investigators practicing within the state of Idaho.

Section 4.

To adopt and promote the highest ethical practice of the profession.

 

Article Three

 

(Membership types)

 

Section 1.

There shall be two types of membership:

A. Active membership is available to individuals, partnerships and corporations who conduct business as either a Private Investigator, Security Consultant, Protective Agent or an Investigative consultant in the state of Idaho. Active members have voting rights within the association. Membership dues are $150.00 per year

B. Associate membership is available to persons employed by a licensed agency(where applicable), corporation or Active Member in good standing. This membership is available to those in an associated industry or those who have been licensed in another jurisdiction. Non-licensed individuals who are eligible for Associate Member status are trainers, attorneys and active law enforcement officers. No voting rights accompany this membership. Associate member fees are $200.00 per year

Section 2.

Any eligible person for membership in any of the two categories shall submit all required information to the membership committee, which consists of the four appointed officers. A majority vote of the membership committee shall be required to enroll a member.

Section 3.

Forfeiture of membership shall occur when there is a failure to pay dues(for the yearly background check) within thirty(30) days after the due date of the date of application for new members or January first of each succeeding calendar year for renewing members. Each individual case of possible forfeiture of membership shall be reviewed by the President and Vice President.

Section 4.

Re-instatement of membership will be granted on full payment of the total arrears of such dues without penalty or further imposition.

Section 5.

Membership may also be terminated in this association for disregard or infraction of the by-laws and procedures of this association, or acts which would constitute anything inconsistent with the ethics, behavior and aims of this association, or any deliberate crime committed against the laws of any city, state, or the United States Government, wherever committed.

Any member so charged shall be afforded the opportunity to answer such charges in person and introduce any evidence relative to his/her defense.

Upon finding true cause by the membership committee regarding such a complaint, the member shall be dropped from membership from this association.

All records of charges, hearings, and findings concerning violations of this section, shall be confidential. The only persons having access to such records shall be the member charged, the President and the Vice President.

 

Article Four

 

( Membership requirements )

Section 1.

A person is NOT eligible for membership who:

1. Is not a citizen or legal resident of the United States.

2. Has been convicted of a felony( No exceptions).

3. Is on probation or parole, or named in an outstanding arrest warrant.

4. Has been dishonorably discharged from the armed forces of the United States.

5. Has been declared by a court of competent jurisdiction to be incompetent by reason of mental or physical defect or disease unless a court has since declared the person to be competent; or

6. Has been denied issuance of a private investigator license , or having held a private investigators license, has had said license suspended or revoked without being subsequently reinstated, in any state or jurisdiction where a private investigators license is required.

7. Has been charged with ANY crimes involving moral torpitude, or any charges involving a minor.

Section 2. All applicants shall submit all required information to the Private Investigators Association of Idaho and upon review from the membership committee, shall be either enrolled or denied based on qualifying criteria. Any falsification or incorrect information given will be an automatic denial of membership.

 

Article Five

(Membership)

 

Section 1.

Dues:

A. Shall be in the annual amount established by the membership committee.

B. Cover a membership year from January 1 to December 31.

C. Are payable to the Private Investigators Association of Idaho.

Section 2..

Evidence of membership.

The membership committee may authorize the procurement of Certificates of Membership in the Association, badges, pins, emblems, flags, or other indicia of membership, and may prescribe the conditions in which such indicia of membership shall be sold or awarded to the members.

Section 3.

Voting.

Active members in good standing may participate by voting in elections, at the annual meeting, and when asked to do so by the membership committee.

 

 Article six

 

(Membership committee)

 

Section 1.

The Membership Committee shall be composed of four members, President, Vice President, Treasurer, and Secretary. The Committee shall represent the Association in all interests involving membership or anything pertaining to the Associations well being.

Section 2.

Powers and duties

A. To represent the membership as decision makers and organizers.

B. To accept and review membership applications and make application decisions.

C. To distinguish honorary members.

D. To establish the amount of annual dues.

 

E. To maintain financial accountability of the Association monies.

F. To authorize evidence of membership.

G. To terminate a member.

H. To fill Committee vacancies by vote of majority until the next annual meeting.

I. To appoint committees.

J. To authorize and present publications and activities, including the annual meeting.

K. To decide upon and cause to be carried into effect all measures which may be deemed proper and expedient to promote the objectives and purposes of the Association.

L. To keep accurate records of all proceedings of the Association.

Section 3.

Officers.

None of the Officers shall receive any compensation or salary from the Association or any of its members. The President shall remain in office for a period of four(4) years from the date of taking office. The Vice President shall remain in office for a period of two(2) years from the date of taking office. The Treasurer and Secretary shall both remain in office for a period of one(1) year from the date of taking office. All positions of office are open for re-election at the end of each offices term. Elections shall be held at the annual meeting.

 

Article Seven

 

(Ammendments)

 

Section 1.

Proposed amendments to these by-laws and procedures must be submitted in writing to the President or Vice President for review. Any such amendment shall be voted on by the Membership Committee and a simple majority vote is needed to pass a proposed amendment.

 

These By-Laws and procedures are lawfully entered and adopted this 13th day of May, 2008 . The Private Investigators Association of Idaho is an existing Association in the state of Idaho.
